I, the undersigned, acknowledge and agree to the following in connection with my participation in Fortify: A Mainstay Strength Program (hereinafter referred to as “the Program”):
1. Voluntary Participation:
I understand that participation in the Program is voluntary and that it involves physical activities that may include but are not limited to strength training, stretching, cardiovascular exercise, and other fitness routines.
2. Assumption of Risk:
I recognize that engaging in fitness activities carries inherent risks, including but not limited to, injury, illness, muscle strain, heart attack, or other health complications. I acknowledge that I am solely responsible for assessing my own physical condition and determining my ability to safely participate in the Program.
3. Consultation with a Healthcare Provider:
I affirm that I have consulted with a qualified healthcare provider or physician before beginning this Program or any physical activity associated with it. I confirm that I have no medical conditions that would prevent me from safely participating in the Program.
4. Release of Liability:
I hereby release, waive, and discharge Mainstay Performance LLC, its coaches, employees, agents, and affiliates from any and all claims, liabilities, or damages arising out of or connected to my participation in the Program, including but not limited to personal injury, property damage, or death.
5. Indemnification:
I agree to indemnify and hold harmless Mainstay Performance LLC from any and all claims or causes of action resulting from my participation in the Program.
6. Technology Disclaimer:
I understand that the Program is conducted online and may require the use of internet-based platforms, which are subject to technical issues or interruptions. I assume full responsibility for ensuring a safe workout environment and proper equipment use during the Program.
By entering my name below, I confirm I have read this liability waiver thoroughly and understand its terms. I understand that I am giving up substantial legal rights by signing it, and I do so voluntarily and of my own free will.
